Law No.675/96 amended by decree-law No.196/2003 on personal data processing Art.10 Information provided at the collection time (law No. 675/96 modified by decree-law No.196/2003) The person concerned or the person by whom personal data are collected shall be previously informed verbally or in writing about: a) The processing purpose and method data are submitted to; b) The mandatory or voluntary nature of the data assignment; c) Consequences of possible refusal to answer; d) Subjects or kinds of subjects these data can be disclosed to and the scope of disclosure of the same data; e) Rights pursuant to art. 13; f) The name, style or trademark and the domicile, residency or registered headoffice of the holder, of the representing subject in the National territory and at least of one person responsible, to be mentioned in the subject possibly appointed pursuant art.13, mentioning the site of the communication network or the method through which there is an easy access to an updated list of persons in charge. 2. The provisions of paragraph 1 cannot envisage the elements already known to the person who supplies data or the knowledge of which could hinder the fulfilment of public inspection or control functions, performed for the fulfilment of purposes pursuant to article 4, paragraph 1, letter e), and 14, paragraph 1, letter d). 3. When personal data are not collected at the subject concerned, the provisions pursuant to paragraph 1 are given to the subject concerned at the data registration time or, in case their disclosure were foreseen, not after the first communication. 4. The provisions pursuant to paragraph 3 do not apply when the notification to the person concerned implies the use of means that the Garantor states to be clearly unsuitable compared to the safeguarded right, or it is impossible, upon the Garantor's opinion, or in case data are processed according to an obligation envisaged by law, regulations or community directive. The same provision does not apply when data are processed to fulfil defence investigations pursuant to law No.397 dated December 7th 2000 or, however, to enforce or defend a right in a lawsuit or proceedings, provided that data are exclusively processed for such purposes and for the period strictly necessary to their completion. Art.13 Rights of the person concerned 1. In relation to the personal data processing the person concerned has the right to: a) know, through the free access to the register pursuant to article 31, paragraph 1, letter a), the existence of data processing that can concern him/her; b) be informed on the content of article 7, paragraph 4, letters a), b) and h); c) obtain, at the care of the holder or people in charge, and without delay: 1) the confirmation of the existence or absence of personal data that concern him/her, even though not yet recorded, and communication in intelligible form of the same data and their origin, as well as the logic and purposes of the data processing; the request can be renewed, without prejudice to justified reasons, within a time period not less than ninety days; 2) the cancellation, transformation in anonymous form or the block of data processed in breach of law, including those of which preservation is not necessary for the purposes of the data collection or further processing; 3) the update, the correction or, in case of interest, data integration; 4) the certificate that operations pursuant to 2) and 3) have been notified also as far as their content is concerned, of those whom data have been communicated or disclosed to, except in case this fulfilment is impossible or implies the use of means clearly unsuitable compared to the safeguarded right; d) oppose, in whole or part, for legitimate reasons, the personal data processing concerning him/her, although pertaining to the collection purpose; e) oppose, in whole or part, the personal data processing concerning him/her, envisaged for marketing information or forwarding of advertising material or direct sale or for market researches or interactive commercial communication and to be informed by the holder, not after the time when data are communicated or disclosed, of the possibility to freely exercise this right. 2. For each request pursuant to paragraph 1, letter c), number 1), the person concerned can be asked, where the existence of data concerning him/her is not confirmed, a contribution to expenses not higher than the cost actually born, according to the conditions and limits set by the provisions set forth in article 33, paragraph 3. 3. The rights pursuant to paragraph 1 referred to personal data concerning deceased people can be exercised by whoever has an interest in them. 4. In exercising the rights pursuant to paragraph 1 the person concerned can grant, in writing, power of attorney or proxy to individuals or associations. 5. The rules on professional confidentiality concerning journalists apply, except for the news origin.
